Please read these Terms & Conditions ("Terms") carefully before using dustinhudlowcoaching.com (the "Site") or purchasing coaching services from Dustin Hudlow Coaching ("we," "us," "our," or "the Company"). By accessing the Site or enrolling in our services, you agree to be bound by these Terms.
1. About Our Services
Dustin Hudlow Coaching provides online fitness, nutrition, and mindset coaching services, including but not limited to personalized training plans, nutritional guidance, mindset coaching, and related digital content ("Services").
2. Not Medical Advice
Our Services are not a substitute for professional medical advice, diagnosis, or treatment. Dustin Hudlow is a fitness/nutrition/mindset coach, not a licensed physician, dietitian, or mental health professional (unless otherwise stated). Always consult your physician before beginning any exercise, nutrition, or wellness program, especially if you have any pre-existing medical conditions, injuries, or concerns.
You should not disregard, avoid, or delay obtaining medical advice from your healthcare provider because of information provided through our Services.
3. Assumption of Risk
Participation in fitness and exercise programs carries inherent risk of injury. By using our Services, you voluntarily assume all risks associated with physical activity, including but not limited to injury, aggravation of a pre-existing condition, or other health consequences. You confirm that you are physically fit and have no medical condition that would prevent your participation, or that you have consulted a physician and received clearance to participate.
4. No Guarantee of Results
While we are committed to helping you achieve your goals, we do not guarantee specific results. Fitness, nutrition, and mindset outcomes depend on many factors, including individual effort, consistency, genetics, and adherence to the program. Testimonials and examples shared on our Site represent individual experiences and are not a guarantee that you will achieve the same or similar results.
5. Eligibility
You must be at least 18 years old to use our Services or enroll in coaching. By using our Services, you represent that you meet this requirement.
6. Payments, Packages & Billing
Coaching packages, programs, or subscriptions are billed as described at the time of purchase (one-time payment or recurring billing, as applicable to your selected package). All prices are listed in U.S. Dollars unless otherwise stated. Payments are processed through secure third-party payment processors. We do not directly store full payment card details.
Recurring/subscription plans will automatically renew and be billed on the applicable cycle until canceled. You are responsible for canceling before the next billing date to avoid additional charges. It is your responsibility to keep your payment and contact information current.
7. Cancellations & Refunds
Refund and cancellation terms will be provided at the time of purchase or in your coaching agreement. Unless otherwise stated in writing, all sales are final and non-refundable once coaching services or digital content have been delivered or access has been granted. Subscription-based programs may be canceled at any time to stop future billing, but past payments are non-refundable unless required by law.
8. SMS & Email Communications
We use SMS messaging to send appointment reminders, coaching updates, service notifications, and promotional offers to contacts who have explicitly opted in. By providing your phone number or email address and opting in, you consent to receive service-related and/or marketing communications from us via SMS and/or email, in accordance with our Privacy Policy (available at dustinhudlowcoaching.com/privacy_policy).
Message frequency varies. Message and data rates may apply. You may opt out of SMS messages at any time by replying "STOP," and you may reply "HELP" for assistance or contact us at (405) 446-5049.
Carriers are not liable for delayed or undelivered messages. T-Mobile, AT&T, Verizon, and other supported carriers are not liable for delayed or undelivered messages.
9. User Conduct
You agree not to use the Site or Services for any unlawful purpose; attempt to gain unauthorized access to our systems or other users' data; copy, resell, or redistribute our coaching content or materials without written permission; or harass, abuse, or harm another person in connection with use of our Services.
10. Intellectual Property
All content on the Site and provided through our coaching programs — including training plans, videos, written materials, graphics, and branding — is the property of Dustin Hudlow Coaching and is protected by copyright and other intellectual property laws. You may not reproduce, distribute, or create derivative works without our express written permission.
11. Limitation of Liability
To the fullest extent permitted by law, Dustin Hudlow Coaching, its owner, employees, and affiliates shall not be liable for any indirect, incidental, special, or consequential damages, including but not limited to injury, loss of income, or loss of data, arising out of or related to your use of our Services, even if advised of the possibility of such damages.
Our total liability for any claim arising from your use of the Services shall not exceed the amount you paid us in the twelve (12) months preceding the claim.
12. Release and Waiver
By participating in our Services, you release and hold harmless Dustin Hudlow Coaching and its owner from any and all claims, demands, or causes of action arising from your participation in fitness, nutrition, or coaching activities, except in cases of gross negligence or willful misconduct.
13. Disclaimer of Warranties
Our Services and Site are provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to fitness for a particular purpose, merchantability, or non-infringement.
14. Governing Law
These Terms are governed by the laws of the State of Oklahoma, without regard to its conflict of law principles. Any disputes arising from these Terms or our Services shall be resolved in the state or federal courts located in Oklahoma County, Oklahoma.
15. Changes to These Terms
We may update these Terms from time to time. Updates will be posted on this page with a revised "Last Updated" date. Your continued use of the Site or Services after changes are posted constitutes acceptance of the revised Terms.
